Service: The Losers Pool (the "Service") provides tools
to create and join "Losers Pool" games based on publicly available NFL
schedules and results.
No affiliation: We are not affiliated with, endorsed by, or sponsored by the NFL or any NFL team. All trademarks belong to their respective owners.
By creating an account, accessing, or using the Service, you accept these Terms of Service and our Privacy Policy. If you do not agree, do not use the Service. If you use the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
Overview: A typical Losers Pool allows participants to pick an NFL team each week they expect to lose. If the chosen team loses that week, the participant advances; otherwise, they are eliminated.
Pool Settings: Pool creators ("Commissioners") can configure rules, including for example:
Public vs. Private Pools: Public pools follow our default rules. Private pools may set house rules that apply to their participants, provided they do not conflict with these Terms.
Official Results: Game outcomes are determined by publicly reported final scores from reputable sources (e.g., official league data). We may correct data errors or obvious mistakes.

We may suspend or terminate accounts/pools that violate these Terms.
You retain ownership of content you submit (e.g., pool names, chat messages, team logos you upload). You grant us a worldwide, non-exclusive, royalty-free license to host, store, display, reproduce, and distribute such content solely to operate and improve the Service. You represent that you have rights to the content you submit.
The Service and all related content, features, and technology are owned by us or our licensors and are protected by IP laws. NFL, team names, logos, and marks are the property of the National Football League and its affiliates. We use publicly available schedules/results for informational purposes only.
We may modify, suspend, or discontinue features at any time. Beta features may be unstable or incomplete and are provided "as is" without warranties.
The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind (express or implied). We do not warrant error-free or uninterrupted operation, accurate or current data feeds, or outcomes. Use the Service at your own risk.
To the maximum extent permitted by law, in no event will we be liable for indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, goodwill, or other intangible losses, arising from or related to your use of the Service.
Our total liability for any claim will not exceed the greater of (a) amounts you paid to us in the 12 months preceding the claim, or (b) $100. Some jurisdictions do not allow certain limitations; in those cases, the limitations apply to the fullest extent permitted by law.
You will indemnify and hold us (and our officers, directors, employees, and agents) harmless from any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from your use of the Service, your content, or your violation of these Terms or applicable law.
We may suspend or terminate access to the Service (including specific pools) for any breach of these Terms or suspected misuse. You may stop using the Service at any time. Certain sections survive termination (e.g., IP, disclaimers, limitations, indemnity, dispute resolution).
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein. Courts in Toronto, Ontario have exclusive jurisdiction for any permitted court proceedings.
Arbitration & No Class Actions (Canada): Except for claims seeking injunctive relief (e.g., IP or security), any dispute arising out of or relating to these Terms or the Service will be resolved by binding arbitration on an individual basis under the ADRIC Arbitration Rules (Arbitration Act, 1991 (Ontario)). Seat: Toronto, Ontario. Language: English. No class, representative, or collective actions.
We may update these Terms. If we make material changes, we will provide notice (e.g., by email or in-app). Changes take effect on the Effective date above. Continued use after changes means you accept the revised Terms.
