The Losers Pool — Terms of Service

Service: The Losers Pool (the "Service") provides tools to create and join "Losers Pool" games based on publicly available NFL schedules and results.

No affiliation: We are not affiliated with, endorsed by, or sponsored by the NFL or any NFL team. All trademarks belong to their respective owners.

2) Acceptance of Terms

By creating an account, accessing, or using the Service, you accept these Terms of Service and our Privacy Policy. If you do not agree, do not use the Service. If you use the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

3) Eligibility & Accounts

  • Age: You must be at least 18 years old to use the Service (planned paid features).
  • Residency/Lawfulness: You may use the Service only where lawful. You are responsible for ensuring your use complies with local laws (e.g., contest/sweepstakes/gaming rules). We do not geo-block by default.
  • Account: You agree to provide accurate information and keep it updated; you are responsible for safeguarding your login. One account per person unless we expressly allow otherwise.

4) Pools, Rules & House Rules

Overview: A typical Losers Pool allows participants to pick an NFL team each week they expect to lose. If the chosen team loses that week, the participant advances; otherwise, they are eliminated.

Pool Settings: Pool creators ("Commissioners") can configure rules, including for example:

  • Season scope: Full season / playoffs / custom weeks.
  • Pick reuse: Allow team reuse? Yes/No; default: No.
  • Pick deadline & grace periods: Day/time, timezone.
  • Tiebreakers/standings: E.g., last longer, cumulative scoring, etc.
  • Forfeits/cancellations: Handling of postponed or canceled games.
  • Commissioner powers: Approvals, removals, dispute resolution.

Public vs. Private Pools: Public pools follow our default rules. Private pools may set house rules that apply to their participants, provided they do not conflict with these Terms.

Official Results: Game outcomes are determined by publicly reported final scores from reputable sources (e.g., official league data). We may correct data errors or obvious mistakes.

5) Fees, Paid Features & Prizes

  • No prize handling: The Service does not collect, hold, escrow, or distribute entry fees or prize pools between participants. Any prizes offered in private pools are solely the responsibility of the pool Commissioner and participants and are handled off-platform.
  • Premium features only: If/when paid premium features or subscriptions are offered, payments are only for platform features and are processed by third-party providers. We do not store full payment card details.
  • No Gambling Operation: The Service is a software platform. We are not a bookmaker or gambling operator and do not take positions on game outcomes. Use the Service for entertainment and skill-based play only where lawful.
  • Refunds: Unless otherwise stated or required by law, premium feature payments are final.
  • Taxes: Winners of off-platform prizes (if any) are responsible for taxes, reporting, and documentation.

6) Fair Play & Prohibited Conduct

You agree not to:

  • Use bots, scripts, scraping, or automation that impacts gameplay or our infrastructure.
  • Collude, multi-account, impersonate others, or otherwise manipulate outcomes.
  • Infringe IP, post unlawful/abusive content, or harass other users.
  • Attempt to bypass technical controls or probe/vulnerability-scan the Service.
  • Use the Service in violation of applicable contest/lottery/gaming laws.

We may suspend or terminate accounts/pools that violate these Terms.

7) User Content & License

You retain ownership of content you submit (e.g., pool names, chat messages, team logos you upload). You grant us a worldwide, non-exclusive, royalty-free license to host, store, display, reproduce, and distribute such content solely to operate and improve the Service. You represent that you have rights to the content you submit.

8) Intellectual Property; NFL Notice

The Service and all related content, features, and technology are owned by us or our licensors and are protected by IP laws. NFL, team names, logos, and marks are the property of the National Football League and its affiliates. We use publicly available schedules/results for informational purposes only.

9) Changes, Availability & Beta Features

We may modify, suspend, or discontinue features at any time. Beta features may be unstable or incomplete and are provided "as is" without warranties.

10) Disclaimers

The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind (express or implied). We do not warrant error-free or uninterrupted operation, accurate or current data feeds, or outcomes. Use the Service at your own risk.

11) Limitation of Liability

To the maximum extent permitted by law, in no event will we be liable for indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, goodwill, or other intangible losses, arising from or related to your use of the Service.

Our total liability for any claim will not exceed the greater of (a) amounts you paid to us in the 12 months preceding the claim, or (b) $100. Some jurisdictions do not allow certain limitations; in those cases, the limitations apply to the fullest extent permitted by law.

12) Indemnification

You will indemnify and hold us (and our officers, directors, employees, and agents) harmless from any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from your use of the Service, your content, or your violation of these Terms or applicable law.

13) Suspension & Termination

We may suspend or terminate access to the Service (including specific pools) for any breach of these Terms or suspected misuse. You may stop using the Service at any time. Certain sections survive termination (e.g., IP, disclaimers, limitations, indemnity, dispute resolution).

14) Governing Law & Dispute Resolution

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein. Courts in Toronto, Ontario have exclusive jurisdiction for any permitted court proceedings.

Arbitration & No Class Actions (Canada): Except for claims seeking injunctive relief (e.g., IP or security), any dispute arising out of or relating to these Terms or the Service will be resolved by binding arbitration on an individual basis under the ADRIC Arbitration Rules (Arbitration Act, 1991 (Ontario)). Seat: Toronto, Ontario. Language: English. No class, representative, or collective actions.

15) Changes to These Terms

We may update these Terms. If we make material changes, we will provide notice (e.g., by email or in-app). Changes take effect on the Effective date above. Continued use after changes means you accept the revised Terms.
